Terms of Service

1. Scope and provider

These terms govern the use of status.tw. They become part of the contract when you create an account or use the interface. If you merely visit the website, the rules in section 4 apply; no contractual relationship arises from that alone.

Deviating terms of the user do not apply, even if we do not expressly object to them.

Who operates the service and how to reach us is set out in the legal notice. How we process personal data is set out in the privacy policy.

2. What status.tw is

status.tw records publicly reachable Teeworlds servers and derives statistics from them about servers, maps, game types and player names, both on the website and through a public interface.

Use is free of charge. No payment obligation arises, neither for us nor for you.

The information displayed originates from the game servers and from the master server and is reproduced unchanged. We do not select it and we do not review it, so we do not owe its accuracy, completeness or timeliness.

3. Account

An account is created by signing in with Discord. There is no entitlement to an account.

You must be at least 16 years old. If you are under 18, you need the consent of your parents or your legal guardian.

Sign-in details and API tokens are to be kept confidential. You are responsible towards us for actions taken through your account insofar as you are answerable for them.

You may have your account deleted at any time. The privacy policy explains how.

4. Rules of use

You may use status.tw for your own purposes, including commercial ones. You are not permitted to:

  • circumvent technical restrictions, in particular the request limit, for instance by distributing requests or by using several accounts or tokens for that purpose,
  • call the interface with the session tokens of the website instead of using an API token for that purpose,
  • disrupt operations or place an unreasonable load on them,
  • exploit security vulnerabilities or search for them deliberately without our prior consent; reporting a vulnerability you come across to the address stated in the legal notice is expressly welcome and will not be treated as a breach,
  • impersonate another person or claim servers you do not operate,
  • publish unlawful content,
  • scrape the website automatically instead of using the interface provided for that purpose; search engines and comparable services that respect robots.txt are exempt from this.

5. Content you provide

In the server manager you may add a website, a Discord invite and a description to a verified server. These details are publicly visible.

You are responsible for these details. You warrant that they infringe neither the rights of third parties nor statutory provisions.

You grant us a simple, royalty-free right, unrestricted as to territory, to reproduce these details publicly on status.tw and through our interface for as long as the server entry exists. We receive no rights beyond that.

We do not review these details before publication. If we become aware of a breach, we may remove or hide the detail concerned and, in the event of repetition, block the server entry or the account. We will inform you of any such measure and state the reason; you may object informally at the address stated in the legal notice.

You may report breaches of these rules to us at the same address.

If these details culpably infringe the rights of third parties or statutory provisions, you shall indemnify us against claims third parties raise against us on that account, including the reasonable costs of our legal defence. We will inform you of such claims without undue delay and give you the opportunity to defend against them. If you do not respond within a reasonable period, we may defend or settle the claim at our reasonable discretion.

6. Interface and use of the data

The interface is available to you free of charge. Technical limits apply to its use, for instance to the number of requests per unit of time and to the number of API tokens, webhooks and server entries per account. The values currently in force are stated in the documentation of the interface; we may adjust them for operational reasons.

API tokens are personal and must not be passed on. We may block individual tokens where they are misused or endanger operations.

Programmatic access to the interface is permitted only with an API token. The session tokens the website uses to sign you in are not intended for that purpose and must not be used for it.

If you use data obtained through the interface, credit status.tw visibly as the source in a suitable place and link to it wherever a link is possible. This obligation follows from these terms and applies regardless of who holds the rights in the individual content.

Insofar as we hold rights of our own in that data, you may otherwise use it freely, including commercially. Third-party rights in individual content remain unaffected; whether you may use such content beyond that is for you to check.

You may not systematically take over the data set in whole or in substantial part in order to offer an equivalent service. Our rights as database maker under sections 87a et seq. of the German Copyright Act remain unaffected in all other respects.

We may develop the interface further, adjust limits and discontinue individual functions. Changes that break existing integrations will be announced in advance where possible.

7. Webhooks

You may register addresses to which we report events. You warrant that you are entitled to dispose of the address you provide.

We do not owe any particular delivery time, or delivery at all. We may deactivate webhooks whose delivery repeatedly fails.

8. Availability

The service is provided free of charge. We do not owe any particular availability; maintenance, disruptions and outages are possible.

We may change or discontinue the service in whole or in part. A complete discontinuation will be announced on the website with reasonable notice.

We are under no obligation to back up your data or to restore it after a disruption.

9. Blocking and termination

You may stop using the service at any time and have your account deleted.

We may block an account or individual functions if you breach these terms. In the case of minor breaches we will notify you beforehand where that is reasonable for us. In the case of serious breaches, in particular attacks on the service, a block may take effect immediately.

Deleting your account removes your API tokens, your webhooks and your server entries. The data from gameplay is unaffected, as it is not tied to your account.

Independently of that, we may terminate the usage relationship with reasonable notice; a reason relating to you personally is not required.

10. Amendments to these terms

We may amend these terms where there is a legitimate reason to do so, for instance changed functions, a changed legal position or adjustments to technical operations.

Material changes will be announced on the website at least 30 days before they take effect. If you do not agree with a change, you may stop using the service and have your account deleted. If you continue to use the service after the change takes effect, the amended terms apply.

Changes that do not disadvantage you, such as new functions or clarifications, may be implemented without prior notice.

11. Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under the German Product Liability Act.

In the case of ordinary negligence we are liable only for the breach of an obligation whose fulfilment makes the proper use of the service possible in the first place and on whose observance you may regularly rely. In that case liability is limited to the foreseeable damage typical of this type of contract.

Liability is otherwise excluded. This applies in particular to damage arising from your reliance on the data provided, whose accuracy and completeness we do not owe under section 2.

12. Final provisions

German law applies. If you are a consumer, the mandatory protective provisions of the state in which you have your habitual residence remain unaffected.

We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.
